ROAD TO A HEARING

For the initial application you should search for your local SSA office and apply. This helpful search tool from SSA will help you locate the right office based on your home zip code: https://secure.ssa.gov/ICON/main.jsp.

 

Majority of the cases get declined during the Initial Stage. If you get approved your benefits will begin shortly thereafter. If you have been declined you have three options:


1) Do nothing
2) File a new claim
3) File for a Request for a Reconsideration within 60 days of the date of notice (recommended).

Once you file a Request for a Reconsideration your case will be reviewed by SSA again. If you get approved your benefits will begin shortly thereafter. If you have been declined you have three options again:


1) Do nothing
2) File a new claim
3) File for a Request for Hearing within 60 days of the date of notice (recommended).


Our office takes on cases from the initial stage on so do not hesitate to contact us if you have not filed yet!


If you have been declined on the Initial Stage and on Reconsideration you will have an opportunity to have your case heard in front of an Administrative Law Judge (ALJ). This is your one and only time to see someone face-to-face during this process. While legal representation is not required for this step (or any step), it is highly recommended! A qualified disability attorney can present your case in the most favorable manner. If you get declined on this stage your winning percentage drastically drops!
